Electrical Product Defects

Home electronic products have changed the way we live, thanks to the convenience and efficiency they bring to our lives.  However, due to defective design or manufacturing, some products present a safety threat to you and your family.

According to the Federal Emergency Management Agency (FEMA), there are approximately 28,600 home electrical fires each year which result in 310 fatalities and more than 1,100 injuries.  These fires cause $1.1 billion in property damages.

Dangerous electrical appliances, such as defective microwaves, washing machines, stereos, coffee makers, dishwashers, heaters, refrigerators, and other products that require the use of electricity, can turn into hazards that leave you vulnerable to electrocution injuries, burn injuries, or death. A small fire caused by a defective electrical appliance or another item requiring the use of flames could rapidly turn into a devastating blaze that could destroy not just your home but your life and the lives of those you love.

Component failures, electrical surges from lightning, or electrical overloads can cause some consumer electrical products to malfunction and create a spark or small fire that present a danger to your health and home.

In recent years, according to the Consumer Product Safety Commission (CPSC) and other national consumer safety publications, a number of home and consumer products presented dangers to consumers, such as:
  • Heavy metals and toxins such as lead, beryllium, and mercury contaminate some computers, televisions, cell phones, and batteries, and present health hazards to consumers;
  • Electric baseboard and fan-heater thermostats that overheat, causing them to melt and smoke, which poses a fire hazard to residents;
  • Food processors that smoke or catch fire, causing a fire hazard;
  • Electric blankets that malfunction and spark fires;
  • Garage heaters that present a fire hazard, because the products were manufactured without backup devices that turn off the heater in the event of a malfunction;
  • Some handheld hair dryers continue to present an electrocution hazard because they lack an immersion protection device that preempts electrocution and shock injuries from happening when the device makes contact with water;
  • Some electric toys present threats of electric shock and burn injuries to children.
If you or a friend or family member believe that you are using a defective electronic product, contact the Consumer Product Safety Commission and report your product concerns.

The Gilbert Law Group has decades of experience representing injured people and the families of lost loved ones in defective product cases.

Our nationally recognized team of lawyers and our renowned in-house engineering staff thoroughly investigate clients’ cases and work diligently to identify the causes of product malfunctions that caused injury or death to our clients.

Product manufacturers owe customers a duty of care to make products that will not injure or kill you. If an electrical product caused injury to you or a loved one, the designer, manufacturer, and product seller may be liable for damages caused by the product.

Breach of warranty, negligence, and strict liability are three kinds of electrical defect product liability cases.  Design defects, manufacturing defects, marketing defects, failure to warn, and inadequate instructions are some reasons why an injured party may opt to sue a manufacturer for damages.
